What is the ruling on a haci who passed the miqat without entering ihram?

Whoever passes the miqat boundary intending Hac or Umre without entering ihram has committed a violation and must return to the miqat to enter ihram from there. If he does not return and enters ihram from a point beyond the miqat, he must slaughter a sheep (dam) and distribute its meat to the poor of the Haram. This is the view of the majority of scholars. Hz. Peygamber (sallallahu aleyhi ve sellem) designated the miqat boundaries and said: 'These are for the people of those regions, and for whoever comes through them not being of their people, intending Hac or Umre' (Sahih al-Bukhari 1524, Sahih Muslim 1181). Sheikh Ibn Uthaymeen stated in al-Sharh al-Mumti' (vol. 7, p. 86): 'Whoever passes the miqat without entering ihram must return to it. If he does not return and enters ihram from beyond it, he must offer a dam.' The Permanent Committee (Fatwa 4460) confirmed this ruling. For those traveling by air, they must enter ihram before the plane crosses over the miqat boundary.
