If a حاجی in the state of احرام accidentally uses perfume — whether by forgetfulness, ignorance, or being applied by someone else without their knowledge — the majority of scholars hold that no fidyah (ransom/penalty) is required, provided the حاجی removes or washes off the fragrance immediately upon realizing the mistake. This ruling is based on قرآن مجیدic principle that Allah does not hold people accountable for genuine mistakes and forgetfulness, and the hadith in which نبی کریم (صلی اللہ علیہ وسلم) said: 'My ummah has been forgiven for mistakes, forgetfulness, and what they are coerced into.'
Sheikh Ibn Uthaymeen explicitly addressed this scenario, ruling that if a person in احرام applies perfume out of forgetfulness or ignorance of the prohibition, they must wash it off as soon as they remember or learn of the ruling, and no fidyah is due. He distinguished between three cases: (1) intentional use with knowledge — fidyah required; (2) intentional use without knowledge of the prohibition — no fidyah according to the stronger opinion; (3) accidental or forgetful use — no fidyah. In all cases, the perfume must be washed off immediately.
Sheikh Ibn Baz similarly ruled that accidental violations of احرام restrictions do not incur penalties, whether the violation involves perfume, covering the head, or other prohibitions. He emphasized that the حاجی must act to correct the situation as soon as they become aware. If the حاجی deliberately delays removing the perfume after becoming aware, then fidyah becomes due for the period of deliberate continuation.
