Whoever passes the miqat boundary intending حج or عمرہ without entering احرام has committed a violation and must return to the miqat to enter احرام from there. If he does not return and enters احرام from a point beyond the miqat, he must slaughter a sheep (dam) and distribute its meat to the poor of the Haram. This is the view of the majority of scholars. نبی کریم (صلی اللہ علیہ وسلم) designated the miqat boundaries and said: 'These are for the people of those regions, and for whoever comes through them not being of their people, intending حج or عمرہ' (Sahih al-Bukhari 1524, Sahih Muslim 1181). Sheikh Ibn Uthaymeen stated in al-Sharh al-Mumti' (vol. 7, p. 86): 'Whoever passes the miqat without entering احرام must return to it. If he does not return and enters احرام from beyond it, he must offer a dam.' The Permanent Committee (Fatwa 4460) confirmed this ruling. For those traveling by air, they must enter احرام before the plane crosses over the miqat boundary.
